TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAIGENT.AI OR PROCOGIA BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

10.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

13.3 Alternative Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through mediation administered by the British Columbia International Commercial Arbitration Centre (BCICAC).

These Terms are drafted in English. In the event of any discrepancy between the English version and any translation, the English version shall prevail.
